Terms of Use

1. About these Terms

These Terms of Use govern access to and use of InSync, a privacy-first product for real-world interpersonal connection. InSync is currently owned and operated by Caemso Nexus, a sole proprietorship established in the Netherlands ("Caemso Nexus", "we", "us" or "our"). Caemso Nexus is registered with the Dutch Chamber of Commerce (KvK) under number 42102831 and uses the business address Smedestraat 2, 6411 CR Heerlen, the Netherlands.

By using InSync, you agree to these Terms and to the InSync Privacy Policy. If you do not agree, do not use InSync.

For the iOS application, the license to use the app is also subject to the applicable Apple App Store license terms. Unless Caemso Nexus later provides a custom end-user license agreement through App Store Connect, Apple's Standard EULA applies to the app license. These Terms govern the InSync service, user conduct, safety rules and other product-specific conditions.

2. Age and eligibility

InSync is intended only for adults aged 18 years or older. You may not use InSync if you are under 18.

By using InSync, you confirm that you are at least 18 years old and legally able to agree to these Terms. InSync currently relies on age information provided by the user and does not claim to perform government-ID, biometric or other independent age verification.

If Caemso Nexus reasonably believes that a user is under 18 or has misrepresented eligibility, access may be restricted or ended where technically and legally appropriate.

3. What InSync does

InSync is designed to support real-world connection through physical context, private relevance and mutual consent. The product does not promise that every nearby person will be visible, that any specific person will match, or that a connection will lead to contact, friendship, dating, employment or any other outcome.

Identity and other information may be disclosed gradually through the product's consent flow. Physical presence or proximity alone does not entitle one participant to another participant's identity or information.

You are responsible for the text, profile information, photos, contact details and other content you choose to enter, send or disclose through InSync. You must have the right to share that information.

InSync includes controls intended to reduce objectionable content and provide blocking/reporting options, but no technical measure can guarantee that all inappropriate, inaccurate or harmful content will be detected before a user encounters it.

Where information is disclosed directly to another participant, that person may receive or retain a copy on their device. Caemso Nexus may not be technically able to retrieve or erase information from another participant's device after you have voluntarily disclosed it.

7. Consent, safety and real-world meetings

A signal, Wave, match, reveal or connection in InSync is not consent to physical contact, sexual activity, continued communication, entry to a venue, employment, a transaction or any other activity outside the specific in-app action.

Use your own judgment when meeting or interacting with another person. InSync does not conduct background checks and does not guarantee another participant's identity, age, intentions, conduct, location, compatibility or safety.

InSync is not an emergency service. If you believe you or another person is in immediate danger, contact the appropriate local emergency service or law-enforcement authority.

8. Block and Report

InSync provides blocking and reporting routes for connected participants where available in the current product. Block is an immediate product control available to the user. Report allows a user to raise a concern with InSync Support.

Reports can be submitted through the production support route or by contacting info@insync.network. Provide only the information reasonably necessary for us to understand and investigate the issue.

Caemso Nexus may review reports, request additional information and take proportionate action that is technically, legally and operationally available. Because InSync is designed around local and peer-to-peer interaction, some actions that are possible in a centrally hosted social network may not be technically available in the same way.

9. Contact exchange and third-party services

If you choose to exchange a phone number or open a third-party communication service such as phone, SMS or WhatsApp, that action is voluntary. Once you leave InSync or use a third-party service, the third party's terms, privacy practices and technical behavior apply.

Do not share another person's contact details without permission. Caemso Nexus does not control communications that occur outside InSync.

10. Device capabilities and service availability

InSync may depend on device capabilities and permissions such as Bluetooth and, where supported, other physical-context capabilities. Availability and behavior can vary by device, operating-system version, permissions, settings, physical environment and compatibility.

We may change, suspend or discontinue features, and we do not guarantee uninterrupted or error-free availability. Maintenance, platform changes, radio conditions and third-party operating-system behavior can affect the service.

11. Privacy

The InSync Privacy Policy explains how personal information is handled. InSync is designed to reduce unnecessary disclosure and to keep significant parts of the interaction local or peer-to-peer, but this does not mean that no data can ever leave a device. For example, information you intentionally share with another participant or submit to Support necessarily leaves your device.

Privacy questions, access requests or deletion requests concerning personal information held by Caemso Nexus can be sent to info@insync.network.

12. Intellectual property

InSync, its software, branding, interface, documentation and underlying intellectual property are owned by or licensed to Caemso Nexus, except for third-party components and rights belonging to their respective owners.

These Terms do not transfer ownership of InSync or any underlying intellectual property to you. Your permission to use the iOS app is limited by the applicable App Store license terms.

13. Restriction or termination of access

Caemso Nexus may restrict or end access where reasonably necessary to protect users or the service, comply with law, respond to serious abuse, address security risks or enforce these Terms, subject to applicable law and the technical capabilities of the service.

You may stop using InSync at any time and may remove the app from your device. Removing the app may remove locally stored application data in accordance with iOS behavior, but it cannot remove information previously disclosed to another person.

14. Disclaimers and liability

InSync is a tool that supports introductions and consent-driven interaction; it does not control the conduct of users in the physical world. To the maximum extent permitted by applicable law, Caemso Nexus does not guarantee matches, outcomes, user identity, user conduct or uninterrupted availability.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including mandatory consumer rights that apply to you. Any limitation in these Terms must be interpreted consistently with those rights.

15. Changes to InSync or these Terms

We may update these Terms when the product, safety processes, legal requirements or operating model changes. Material changes will be reflected in an updated version and effective date. Where applicable, we will provide notice or request renewed acceptance before the updated terms take effect.

16. Governing law and consumer rights

These Terms are governed by Dutch law, subject to any mandatory consumer protections and jurisdiction rights that apply to you under the law of your country of residence. Nothing in these Terms is intended to deprive a consumer of rights that cannot lawfully be waived.

17. Apple App Store

If you obtain InSync through Apple's App Store, Apple is not responsible for operating the InSync service, handling InSync support or enforcing these product-specific Terms. The license to use the app is governed by the applicable App Store license terms, including Apple's Standard EULA unless a valid custom EULA is provided through App Store Connect.
